These Terms of Service (“Terms”) govern your access to and use of the website of Black Label Charter Co. (“Black Label,” “we,” “us,” or “our”) and the membership, application, and charter services we offer. By using this site or submitting an application, you agree to these Terms.
Membership Is by Application and Invitation
Black Label is a private, invite-only offshore fishing club operating off the Sarasota coast in the Gulf of America. Submitting an application does not guarantee membership. Applications are reviewed individually, and we reserve the right to accept or decline any application at our sole discretion. Membership, once granted, is personal to you and may not be transferred or shared without our written consent.
Applications and Communications
You agree that the information you provide in your application is accurate and complete. By submitting an application and consenting where indicated, you authorize us to contact you about your inquiry, membership, scheduling, and related matters.
Bookings, Deposits, and Payment
Charters are reserved through our members’ booking system. A deposit may be required to confirm and hold your dates, and the amount due is presented at the time of booking. Deposits reserve the vessel and crew for your selected dates; the balance and any additional charges are handled as agreed at booking. Specific cancellation, rescheduling, and refund terms for a given charter will be communicated to you at the time of booking and form part of these Terms.
Conduct Aboard
The safety of every guest and crew member is paramount. You agree to follow the instructions of the captain and crew at all times. We may refuse or end any charter, without refund, for conduct that endangers safety, violates the law, or disregards crew direction.
Assumption of Risk and Limitation of Liability
Offshore fishing and boating involve inherent risks. To the fullest extent permitted by law, you assume those risks and agree that Black Label, its owners, captains, and crew are not liable for personal injury, loss, or property damage except where caused by our gross negligence or willful misconduct. A separate liability waiver may be required before any charter, and its terms will apply in addition to these Terms.
Intellectual Property
The content, branding, photography, and design of this website are the property of Black Label Charter Co. and may not be copied, reproduced, or used without our written permission.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Florida.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the site or our services after changes are posted constitutes acceptance of the updated Terms.
